Acts according to: the Ukrainian Plan ”Regulation through the democracy” („Ukraine expresses the preparedness to agree to the realization on it’s  territory the short-term monitoring missions of OSCE for the purpose to check the  resettlement of people and cargoes through the Ukrainian-Moldavian border area. Ukraine urges the Trandnistrian  region to take the similar actions”);

Official appeal of the presidents of Ukraine and Moldova to EU concerning the sustenance of the development of the boundary management and the customs control on the general border from 02.06.05;

The memorandum of the mutual understanding between the Government of Ukraine, the Government of Moldova and EC concerning the EC mission on border assistance to Ukraine and Moldova of 07.10.05 and the agreements (in the form of an exchange of notes) between the Government of Ukraine, the Government of Moldova and EC concerning the resumption of the mandate of the EUBAM mission (on 2008-2009, 2010-2011 and 2011-2013).

The beginning of the activity of EC Mission: on December, the 1st, 2005

Mission acts under the EC aegis and is financed by the EC through the Program of the development of the United Nations.

The EC Mission budget:

2005-2007 - 20 million euro under the TACIS program;

2007-2009 - 24 million euro within the limits of the European instrument of the neighborhood and partnership (ENPI);

2010 - 10,5 million euro within the limits of ENPI.

The general tasks of the Mission:

The assistance of realization of the Action plans of the Policy of the neighborhood of EU with Ukraine and Moldova;

The accumulation of the operative and institutional possibilities of Ukraine and Moldova for prevention of the effective control and border protection;

The assistance of resolution of the Trandnistrian conflict;

The raising of standards of the international cooperation in the items of the boundary management.

      By the means of realization of the coordinated actions in the boundary, customs and taxing spheres.

Help points:

- The analysis and adaptation of the national legislation to the European one;

- Supervision in the check points and on "the green" border areas ;

- Rendering of counsels;

- Assistance in framing and formation of the system of risk analysis;

- A technical assistance;

-The interaction improvement at all levels (departmental, interdepartmental, international);

- Holding of the common operations (in general 9 operations are conducted).

Work coordination:

Monthly - Coordinated Council with the assistance of the representatives of the boundary and customs departments of Ukraine and РМ;

 Twice a year –High level Consultative Council with the assistance of the representatives of the boundary and customs departments, the Ministry of Foreign Affairs, the Ministry of Internal Affairs of Ukraine and Moldova, OSCE, UNDP.

The representative of the Government of Ukraine (the main contact person for EC Mission) - the head of the International legal department lieutenant general O.G.Melnikov.

For the constant interaction the contact persons at all levels are determined - in Administration, Southern and Western regional governments, boundary detachments and subdivisions of the border protection .

On November, 21st, 2006 in Brussels during the 5th round of the consultations of the Ukrainian experts, EU and Moldova as for the Trandnistrian settlement the Protocol about information interchange between the boundary departments of Ukraine and Moldova is signed .

 

 Within the limits of the project of the technical assistance BOMMOLUK:

The computer and office equipment, the software for subsections of risk analysis and the criminal analysis, a minivan Volkswagen on 562 thousand dollars is received.

Also the Mission transferred the fuel on 10 thousand euro (2009), the equipment for mobile subsections on 35 thousand euro (2010), the equipment for a class of English language of the Educational centre on 10 thousand euro (2011).

 

The Mission personnel:

- 103 representatives of the boundary, customs and law-enforcement services of the EU countries and 119 local personnel members (Ukraine and РМ ) - as of December, 2010

The basic conclusions of EUBAM Mission:

> Despite the complexity of a given situation, the conditions on the Ukrainian-Moldavian border are under control;

> On the Trandnistrian segment «a black hole» is missing;

> The interaction of the boundary departments of Ukraine and Moldova is on the appropriate level and allows to control effectively the border area and to counteract the organized crime activity.

The Estimation of EUBAM Mission activity is positive:

The Mission recommendations became more practical;

There is an aspirations for solving the revealed problems, including with the assistance of the European law-enforcement agencies, Interpol;

The efficiency of the mutual operations has raised.

 

Cooperation condition

Nowadays the accurate system of interaction with EUBAM Mission is adjusted. State Borderguard Service of Ukraine operatively reacts to the recommendations of Mission in sphere of the intensification of the regional boundary safety.

Recommendations and Mission counsels, educational trainings are useful and actual.

The Working groups from the improvement of functioning of the general check points, counteraction of the illegal migration and drug and weapon smuggling have been formed and are still acting;

An active work on preparations for the experiment from the joint control in the check point "Rososhani - Brichen" continues, comes to the end the handling of the corresponding protocol;

The practice of holding the joint operations of law enforcement establishment (operation "Akerman") proceeds;

The Considerable work on supporting the application of the risk system analysis, raising the professional level of the Service personnel, including teachers - multiplicators is conducted,

The information interchange with FRONTEX and EUROPOL (direct monthly reports) is adjusted;

The considerable aid as for the improvement of the system of the corruption counteraction and in work with mass media is given.

We are obliged to the Mission for starting the work in such directions, as:

The improvement of the activity of the mobile subsections according to the Concept of it’s development,

the improvement of the English language teaching.

The realization of the project on creation of 2 exemplary check points / «Starokozache - Tudora» and «Mogilyov-Podolsk - Otach»/,

Holding the international school for the cadets and students from an anticorruption policy,

Especially important there is a help of Mission concerning introduction of the Concept of the Integrated borders management and preparations for EURO 2012.

 At present  within the framework of cooperation with the Mission:

The following groups are created and operate:

 

o       Counteractions of illegal migration;

o       Counteractions of contraband;

o       Information interchange improvement;

o       Improvement of activity of general check points;

o       Improvement of activity of mobile subsections;

o       Introduction of general patrol of the Ukrainian-Moldavian border;

Within their framework the following has been done:

Interaction is set and the events for investigation of the offences concerning illegal migration and contraband get on;

The mechanism of information interchange with the Frontier service of Moldova is improved, preparation of general reports on the borders’ safety is implemented (monthly, quarterly and annually) about the conditions on the Ukrainian-Moldavian border which are sent to Euro commission, Agency FRONTEX and Європолу, embassies of the EU countries;

The  mechanism of carrying out of experiment on the improvement of the general control in the check point «Rososhani - Brichen» is coordinated and the project of the corresponding agreement is processed; the optiko-fiber cable for provision of work of the telecommunication equipment in a check point is laid at the cost of the EUBAM Mission;

 

A number of trainings are conducted and the  necessary equipment for mobile subsections of Southern regional government  is purchased;

The mechanism of general patrol of the Ukrainian-Moldavian border is agreed, the project of the corresponding agreement is processed and the  preparation of a training course with general patrol is started;

 

The practice of carrying out the general operations of law enforcement bodies of Ukraine and Moldova is implemented with the assistance of the representatives of law enforcement bodies of the EU countries. In total 8 operations are conducted during which the mechanism of fast information interchange and the realization of the investigations are worked out.

The essential help in the system of risk analysis formation and the preparation of the analysts is given (training of the personnel is performed on a constant basis).

 

The recommendations in the sphere of the integrated management of the borders and boundary safety are proceeded and implemented according to the European practice (2 Reports on the needs and recommendations have been prepared).

 

A number of new projects are implemented. They are as following:

1) «Exemplary check points» ("Starokozache" and "Mogilyov-Podolsk-car") which implies the training of the personnel on the points of the anticorruption policy and the observance of the professional etiquette rules.

2) «Coordination points» together with Agency FRONTEX (the first project outside of the European Union). In its frameworks the representatives of the frontier services of the EU countries take part in realization of the boundary control and training the personnel of the check points.

The help in developing the projects of the legal acts has been given, in particular  - the law of Ukraine «About the boundary control» ,the Concept of the integrated management of the borders and the Actions plan on its realization.

The following has been done within the framework of the preparation for EURO 2012:

With the assistance of the representatives of Federal police of Germany a number of trainings for the personnel of check points concerning the managing of the conflict situations in check points are conducted; on the basis of this program the training course for the personnel of check points is worked out;

 

The strategy of communications with the mass-media during Euro-2012 is processed and the production of corresponding information stands in check points is begun;

The course of intensive English studying  is worked out and the assistance in preparation of the instructors  for its carrying out in border guard bodies  is given;

10 thousand copies of the Ukrainian-English phrase book to EURO 2012 are published.

Anticorruption initiatives are actively implemented. So, together with the EUBAM Mission:

Three summer schools «Youth against corruption» are conducted for students of the educational institutions of law-enforcement departments and civil educational institutions of Ukraine and Moldova;

The independent questioning of the personnel of the service and the people who cross the border is annually held;

The preparation of a training course concerning corruption counteraction is begun with the assistance of the specialists of OSCE.

The assistance in acquaintance with the best European practice and the increase of professional level of the personnel is given:

Two International conferences on the integrated management of the borders are held;

34 educational trips to the EU countries are organized with the participation of over 110 representatives of the State border guard service;

The trainings on  different aspects of office activity are constantly held,

 A number of training courses, the administrative course for the administrative board and the course of distance learning to the chiefs of the border  subsections in particular, are worked out and implemented.

In total, from 2006 to  2011 1580 representatives of the State border guard service participated in the trainings.

It has been also accented, that according to point 5 chapter  17 of the Law of Ukraine «About the boundary control» the boundary control of the aircrafts, which cross the state border with the intermediate landing at the several airports (in airdromes) on the Ukraine’s territory, is performed in a case of:

Arrival - at the first airport (on the airdrome) on the arrival to Ukraine;

Departure - at the last airport (on the airdrome) on the  departure from Ukraine.

That is, on an arrival the border control will be performed at the airport Simferopol, on a departure - at the international airport "Borispol". From Simferopol to Kiev flight will go as an internal one.

At the same time, the representatives of the Embassy of Tajikistan have been warned about obligatory responsibility of the international air carriers for the  transportation of the offenders.

The director of the International legal department  has also informed the Ambassador of Tajikistan in Ukraine, that in comparison with 2010, during 2011 the number of citizens of Tajikistan, who have been refused the admission through the border of Ukraine, has considerably decreased (2010 - 2082 people, 2011 - people). The main reason of refusal is non-confirmation of the purpose of the trip – 545 persons. From the total number of the detained citizens of Tajikistan: 72 % are detained on Ukrainian-Russian, 26 % - on Ukrainian-Belarus frontier lines.

During the meeting the Ukrainian side has reported that the Administration the State border guard service of Ukraine will prepare within its competence, and will send the letter to the Ministry of Foreign Affairs of Ukraine with the stated standpoints as to the questions mentioned during the meeting.

The ambassador of Republic Tajikistan in Ukraine has thanked for mutual understanding and has stated expectation concerning the development of prolific cooperation in the future.

The meeting has passed in constructive and business atmosphere.
